What is the difference between freehold and leasehold in Kenya?
2 November 2026
Freehold means you own the land with no end date. Leasehold means you hold it for a fixed term, such as 50 or 99 years, and you may owe yearly land rent. Only Kenyan citizens can hold freehold. Both can be good purchases, as long as you know which you're buying and how many years remain.

Freehold
- No expiry date.
- Generally no land rent, though county rates can still apply.
- Open to Kenyan citizens and to companies wholly owned by citizens.
- Planning and zoning rules still limit what you can build.
Leasehold
- Runs for a fixed term, after which the land reverts unless the lease is extended.
- Land rent may be payable, so ask for proof it's up to date.
- The only option for non-citizens, up to 99 years. See can foreigners buy property in Kenya.
- Common for apartments, where you usually own a unit and share the land.
Why the difference matters to you
Time left on the lease. A lease with 80 years left is very different from one with 15. As the term runs down, it can get harder to sell.
Getting a mortgage. Lenders look at the remaining term when deciding on a loan, so ask your bank early if the lease is short.
Renewal. Extension isn't automatic. Budget for the possibility of fees and paperwork, and ask your advocate how it works for that plot.
How do you find out which you're buying?
The title and the official search should show it. Read both, rather than relying on a listing or an agent. Our listings state freehold or leasehold where we know it, but verify the title yourself before paying anything.
Which is better?
Freehold is simpler if you're a citizen and want to hold land for generations. A long leasehold can suit you just as well, especially for an apartment. Compare the price, the years remaining and any land rent, rather than treating one as automatically better.
Frequently asked questions
Can a Kenyan citizen buy leasehold property?
Yes. Citizens can hold either, and many apartments and plots are leasehold.
What happens when a lease expires in Kenya?
The land reverts unless the lease is extended, so don't leave this until the end of the term. Take advice well in advance.
Do I pay land rent on freehold?
Land rent is generally a leasehold cost. County rates are separate, so check what's due on any property.
